We were always on time with our payments until April 2009 due to company transfer and sick parent. We rented the property to tenants, and hired a rental management company, the fabulous tenants have not paid any rent since February 2009, this is when my husband was laid off. Due to all this we have been unable to pay our mortgage and due to an adjustable rate that kept adjusting up to $1900. We contacted our lender countrytime and asked to do a short sale but we have not been successful with our Realtor, tenants and keeping the house out of foreclosure..

After several conversations with our lender in which the Company stated that various documents had not been received, I reacted immediately with faxes to cover the loss, including the listing agreement. No action to move the documents along to the bank were done. My latest conversation with the bank's liquidation department informed me that the house had a sale date on June 12, 2009.
The loss mitigation specialist stated that my package was incomplete, since there was no listing agreement ,no request to participate in the program , no hardship. I was out of ideas and now all my paperwork is 90 days old, I would probably not be accepted now. so I pointed out that this process was started in a timely fashion and that no specialist at the bank ever gave me that excuse before. he put me on hold for a while and then returned. he asked me about the date on the listing agreement. I read the dates on the contract. The expired contract was May 31, 2009 with a month to month extension,
